Inc. BUSINESS POLICIES
Any agreement
for the purchase of goods and/or services from Most Networks, Inc. shall
be governed by and is made subject to these Business Policies and the
Returns Policies stated below (collectively, the "Policies"). Most Networks,
Inc. may, at its sole option, revise the Policies from time to time without
notice. Prices and availability are subject to change without notice.
Photos may not represent actual product. Typographical, product description,
pricing and other errors are subject to correction, even after orders
and/or payment are accepted. Manufacturer warranty, if any, applies; Most
Networks, Inc. HEREBY DISCLAIMS ALL OTHER WARRANTIES, INCLUDING BUT NOT
LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
PURPOSE. Most Networks, Inc. does not guarantee product compatibility.
Not all products are eligible for return, and not all products that are
eligible for return are to be returned to Most Networks, Inc. Carefully
review all return policies (below) before making your purchase. Shipping
charges are not refundable. All customers, by ordering from our website,
agrees to be bound by all of the terms, policies and conditions stated
thereon.
Governing Law
Any purchase of goods from Most Networks, Inc. shall
be governed by and construed in accordance with the laws of the State
of New Jersey, without giving effect to any principles of conflicts of
law. Those who choose to access this site from other locations do so on
their own initiative and are responsible for compliance with local laws,
if and to the extent local laws are applicable. Except for equitable relief
sought by Most
Networks, Inc., which may be sought in any court
of competent jurisdiction, user consents to the exclusive jurisdiction
of the State and Federal courts located in New Jersey.
Limitation of Remedy
IN NO EVENT SHALL MOST NETWORKS, INC. BE LIABLE FOR
ANY DAMAGES CAUSED BY ANY PRODUCT OR SERVICE OR THE FAILURE OF SUCH PRODUCT
OR SERVICE TO PERFORM, INCLUDING BUT NOT LIMITED TO ANY LOST PROFITS,
LOST SAVINGS, LOSS OF USE, LOSS OF DATA, OR ANY OTHER SPECIAL, INCIDENTAL,
INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER OR NOT ADVISED
OF THE POSSIBILITY OF SUCH DAMAGE, AND REGARDLESS OF THE THEORY OF LIABILITY
PURSUANT TO WHICH SUCH DAMAGES MAY BE SOUGHT. MOST
NETWORKS, INC. is not liable for any claim
made by a third party or made by you for a third party.
Most Networks, Inc.obtains certain data directly from the manufacturer
or distributor of certain products. While Most Networks, Inc.makes every
effort to ensure the accuracy of this data, this web site could include
typographical errors and/or technical inaccuracies. Most
Networks, Inc. reserves the right to make
improvements and/or changes to such data and/or this web site at any time.
Most Networks, Inc. makes no warranty of any kind with respect to the
data on this web site or the accuracy of advice given by Most Networks,
Inc. employees, whether or not such advice is made in writing.
Customer's responsibility for certain shipping charges
If customer requests shipping charges be paid either on a collect basis
or on customer's account with the shipping company, and customer refuses
the shipment or refuses to pay the applicable shipping charges, Most
Networks, Inc. may bill customer, and customer
shall pay Most
Networks, Inc., for all resulting charges
incurred by Most Networks, Inc.either directly or through its supplier.
In all instances where customer requests shipping charges be paid either
on a collect basis or on customer's account with the shipping company,
customer shall assume risk of loss or damage to the product during shipment;
Most Networks, Inc.strongly recommends customers obtain insurance for
such shipments, as neither Most Networks, Inc. nor its suppliers will
insure such shipments.

MOST NETWORKS, INC. RETURN POLICIES
GENERAL RETURNS CONDITIONS APPLICABLE TO ALL RETURNS:
-Shipping charges are not refundable.
-No returns
will be accepted without prior authorization and a Most Networks, Inc.
return merchandise authorization ("RMA") number.
-RMA numbers issued by Most Networks, Inc.are good for 7 days only, and
product must be received by Most Networks, Inc.within that time. RMA numbers
cannot be extended or re-issued.
-Where a specific return period is applicable (see below), no returns
will be accepted beyond that period. Return authorizations will not be
granted after the stated return period has run.
-Customer is responsible for shipping charges and risk of loss on all
return shipments. Most Networks, Inc. highly recommends using a reputable
shipping carrier capable of providing proof of delivery, as well as properly
packing and fully insuring your return shipment.
-Please note below any and all additional returns conditions applicable
to your return.
Additional returns conditions applicable to all software:
1. Software is not returnable to Most Networks, Inc.
for credit or exchange. In many instances software manufacturers will
offer a limited money back guarantee. Please look at the documentation
provided within the product packaging for phone numbers and return procedures.
2. Volume software licensing must be ordered by contacting
Most Networks, Inc.
Additional returns conditions applicable to all hardware
products that are not specifically addressed below:
1. Product that is in its original factory-sealed container
may be returned to Most Networks, Inc. within 15 days from invoice date
for a refund or exchange.
2. Product that has been opened may be returned to Most Networks, Inc.
within 15 days of invoice date and with an approved RMA number, although
such returns will be charged a 25% restocking fee. All products must be
returned in a re-saleable condition. Any missing or damaged products,
components or accompanying items will result in rejection of the return
or an additional restocking fee, at Most
Networks, Inc.' sole option.
3. Product that is DOA (dead on arrival) or defective may be returned
to Most Networks, Inc.for refund or exchange within 15 days of invoice
date with no restocking fee.
Additional returns conditions applicable to all IBM and Compaq products
(excluding Compaq Presario computers; see below):
1. IBM and Compaq
products are not returnable to Most
Networks, Inc..
2. If a product arrives DOA (dead on arrival), or if any product or part
is defective, the customer should contact the manufacturer directly for
service or exchange. Due to manufacturer policies, Most Networks, Inc.
cannot accept these returns for service or exchange. IBM can be contacted
at 1-800-772-2227; Compaq can be contacted at 800-OK-COMPAQ.
Additional returns conditions applicable to all Xerox
products:
1. Due to manufacturer policies, opened Xerox products
are not returnable toMost
Networks, Inc.
2. Product that is in its original factory-sealed container may be returned
to Most Networks, Inc.within 15 days from invoice date for a refund or
exchange.
3. If a product arrives DOA (dead on arrival), or if any product or part
is defective, the customer should contact Xerox directly at 1-800-835-6100
for service or exchange. Due to manufacturer policies, Most Networks,
Inc. cannot accept these returns for service or exchange.
Additional returns conditions applicable to all Hewlett-Packard
(HP) Pavilion products:
1. Due to manufacturer policies,
these products are not returnable to Most
Networks, Inc. Exception: Product that arrives
DOA (dead on arrival) may be returned to Most
Networks, Inc. for refund or exchange within
15 days of invoice date with no restocking fee.
2. If any non-DOA product or part is or becomes defective, the customer
should contact the manufacturer directly for service or exchange. Due
to manufacturer policies, Most Networks, Inc. cannot accept these returns
for service or exchange.
Additional returns conditions applicable to all Hewlett-Packard
(HP) ProCurve networking products:
1. Due to manufacturer policies,
opened HP ProCurve products are not returnable to Most
Networks, Inc.
2. Product that is in its original factory-sealed container may be returned
to Most Networks, Inc. within 15 days from invoice date for a refund or
exchange.
3. If a product arrives DOA (dead on arrival), or if any product or part
is defective, the customer should contact HP directly at the numbers listed
below for service or exchange. Due to manufacturer policies, Most
Networks, Inc. cannot accept these returns
for credit or exchange.

products:
1. Due to manufacturer policies, these products are
not returnable to Most
Networks, Inc. Exception: Product that arrives
DOA (dead on arrival) may be returned to Most Networks, Inc. for EXCHANGE
ONLY within 15 days of invoice date with no restocking fee.
2. If any non-DOA product or part is or becomes defective, the customer
should contact the manufacturer directly for service or exchange. Due
to manufacturer policies, Most Networks, Inc.cannot accept these returns
for service or exchange.
